Gone fishing and drilling ratholes. Blind rams and vertical crawlers…

Energy and Oil & Gas Disputes

Energy and Oil & Gas disputes are just better. What other sector sends a crawler down a two kilometre deep hole to blow itself up and thus cut the drill pipe?

We understand the technical nuances pertinent to the energy and oil and gas sector, from operational structures and specialist contracts to the unique and technical issues that form a daily part of operations. We also understand and enjoy the pragmatism of the sector: many times, the parties in a dispute will have an eye to the future where they expect or hope to work further with each other.

That understanding informs an approach of ensuring clarity from the outset for our clients as to process, cost, strength of claim and the inevitable risk factors in any dispute – but also the better opportunities to seek early resolution and minimise the strain on any inter-party relationship that could continue. That said: we will tell you who should win, and if you want us to go to war, then we go to war…

The team is led by Euan Palmer, with more than 15 years of experience advising clients in the sector. We act for international companies on both sides of Operator/Contractor disputes arising out of drilling operations and also Operator/Non-operator disputes arising out of transportation and asset sharing agreements, farm-ins, joint ventures, and other inter-operator agreements.

Energy and Oil & Gas Disputes

How we can help

Contractor and Operator O&G disputes, onshore or offshore

We act on both sides of Operator/Contractor Oil & Gas disputes arising out of drilling services operations, both onshore and offshore;

International Arbitration

Typically the dispute resolution forum of choice for the industry. We run disputes arising in different sectors through all the major arbitral institutions (including the LCIA, the ICC, and the SIAC). And we know when to turn to the courts, whether in England or in other jurisdictions, to obtain any support necessary for the arbitral process.

Operator/Non-operator

Operator/Non-operator disputes arising out of transportation and asset sharing agreements, farm-ins, joint ventures, and other inter-operator agreements.

International and Cross Border

The majority of our clients operate internationally, and we deal regularly with jurisdictional issues arising from the outset of disputes, including as to which country proceedings are best commenced in, or where and how enforcement will take place. Our work will commonly involve either instructing or liaising with lawyers in foreign jurisdictions.

Upstream and downstream

We work with companies throughout the supply chain, including upstream (exploration and production), midstream (storage and transportation) and downstream (fuels and lubricants, marketing and refining, retail and chemicals).

Mediation and other ADR

We are experts in alternative dispute resolution (ADR) in all its forms, whether court action, formal alternative dispute resolution (mediation, expert determination) or informal negotiations.
