Enforcement in the UK

  • We successfully enforced an English judgment in the sum of $US2.25m in the UK. The debtor company was a BVI registered company, and the debt arose from a loan agreement which required payment in US dollars but gave the English court’s jurisdiction to deal with any disputes which arose between the parties. We secured a charging order and order for sale against high-value property in central London and a writ of control against valuable artwork. We also obtained an order to obtain further information from the company director, who was resident in Dubai.

 

  • We are currently in the process of applying for an application for a third-party debt order in relation to a £2.6m judgment which has been obtained in the English courts (third party and defendants are US based) as part of an overall enforcement strategy.

 

  • We have also recently registered, and successfully enforced, foreign judgments from countries as diverse as the USA, Liechtenstein, New Zealand and Spain, in the English courts. We recently advised on the registration of an Australian judgment of approx. AUS$3.5m in England, with the enforcement action including obtaining a charging order over property. Payment was received following an application for an order for sale.
